النظام القانوني للقضاء التجاري المتخصص في التشريع الجزائري

Résumé: في إطار تعديل قانون إ. م. إ بواسطة القانون رقم 22-13 في الجزائر، يهدف إلى تسهيل عملية التسوية القضائية في الحياة التجارية. وتم إنشاء م. ت. م كهيئة قضائية مستقلة تعمل على فض المنازعات المحددة في م 536 مكرر من نفس القانون. وحسب م. ت رقم 23-53 فقد تم توزيع كل من الإختصاص النوعي والإقليمي على 12 محكمة، حيث تتألف كل محكمة من قاض وأربعة مساعدين يتمتعون بالخبرة وتوفر بعض الشروط المحددة فيهم. ومن جهة أخرى، تم اللجوء إلى الوسائل البديلة كالوساطة والصلح قبل رفع الدعوى أمام م. ت. م، لتقليل الضغط على المحاكم. وفي حال عدم نجاح الصلح، يمكن رفع الدعوى بطرق أخرى مع محضر عدم الصلح، وتنتهي الخصومة بحكم قابل للإستئناف أمام المجلس القضائي. Abstract As part of amending the civil and administrative procedure law under law No. 22-13 in Algeria this amendement aims to facilitate and expedite judicial settelement processes in commercial court was established as an independent judicial body responsible for resolving disputes specified in article 536 bis of the law. According to executive decree No.23-53 the distribution of both specialized and regional jurisdiction has been determined for 12 courts each consisting of a judge and four assistants who have expertices and meet certain specified conditions. On the other hand alternative means such as mediation and reconciliation were resorted to be before the courts. In the event of unsuccessful reconciliation the lawsuit can be filed through other methods with a non reconciliation report and the dispute ends with a judgment that is subject to appeal before the judicial council.
