الضمانات المقررة للأحداث الجانحين أثناء سير الجلسة في ظل القانون 15-12

Résumé: تعتبر مرحلة المحاكمة آخر مرحلة في الدعوى ذات الطابع الجزائي، إلا أن الجرائم التي يرتكبها الأحداث تمتاز بنوع من الخصوصية عن الجرائم التي يرتكبها البالغين، حيث أنها تقتضي وجود قضاء متخصص للفصل في هذا النوع من القضايا، وهو ما اصطلح عليه قضاء الأحداث باعتباره يهدف إلى إصلاح الطفل وإعادة تقويمه، الأمر الذي أدى بالمشرع الجزائري أن يقر عدة ضمانات قانونية للطفل أثناء المحاكمة بموجب القانون 15-12 المتعلق بحماية الطفل، خاصة أثناء سير جلسة المحاكمة، وعليه يمكن طرح الإشكالية الآتية: ما هي الضمانات القانونية التي جاء بها المشرع الجزائري للحدث الجانح أثناء سير الجلسة بموجب القانون 15-12 المتعلق بحماية الطفل؟ abstrat The stage of the trial is the last stage in the criminal case, but the crimes committed by juveniles are characterized by a kind of privacy for crimes committed by adults, as they require a specialized judiciary to adjudicate this type of case, Which led the Algerian legislator to adopt several legal guarantees for the child during the trial under Law 15.12 on the protection of the child, especially during the course of the trial session.
