تنظيم حالة شغور منصب رئيس الجمهورية في ظل التعديل الدستوري 2016 في الجزائر

Résumé: الملخص يعالج هذا البحث الأوضاع الدستورية التي تحكم تنظيم شغور منصب رئيس الجمهورية في الجزائر وفق ما نص عليه المؤسس الدستوري في التعديل الدستوري لسنة 2016، ينطلق هذا البحث من أهمية منصب الرئاسة ودورها في النظام الدستوري ليطرح إشكالية حول مدى إحاطة المؤسس الدستوري الجزائري بكل الجوانب التي تسمح له بتنظيم واضح ودقيق لشغور منصب الرئيس بما يضمن استمرار ممارسة المهام الرئاسية، ويخلص هذا البحث من خلال استعراض القواعد الموضوعية والإجرائية في هذا المجال إلى أن المؤسس الدستوري فضل حماية الرئيس وعزّز من حصانته من خلال وضع نظام غير متكامل ويفتقد للآليات العملية التي تسمح بتحريكه. English abstract This research treats the constitutional conditions governing the organization of the vacancy of the post of President of the Republic in Algeria, as stipulated by the constitutional constituent in the constitutional amendment of 2016. This research stems from the importance of the presidency and its role in the constitutional system to raise the question of the extent to which the Algerian constitutional constituent succeeds , In a clear and precise organization of the vacancy of the post of president in order to ensure the continuation of the exercise of presidential functions, and concludes by reviewing the substantive and procedural rules in this way that the constitutional constituent preferred the protection of the President and strengthened his immunity through the a system which is lacks the practical mechanisms to launch it.
