الحماية القانونية لنوع الجنين في التشريع الجزائري دراسة مقارنة في ضوء أحكام الشريعة الإسلامية

Résumé: استهدفت الدراسة الحالية تجلية مدى الحماية القانونية لنوع الجنين في التشريع الجزائري مقارنة في بأحكام الشريعة الإسلامية. واستندت الدراسة إلى المنهج الوصفي. واعتمدت في إطار ذلك على الأسلوب المقارن. وتمثلت أداة الدراسة في مسح الأدبيات المتعلقة بموضوع الدراسة. وأسفرت الدراسة عن العديد من النتائج أبرزها الآتي: سكت التشريع الجزائري عن مسألة الكشف عن نوع الجنين مما يفهم منه إقراره لها، وهو بذلك يخالف الراجح في الفقه الإسلامي الذذي ذهب إلى عدم جواز الكشف عن نوع الجنين – يتفق التشريع الجزائري مع الراجح في الفقه الإسلامي في منع عمليات انتقاء نوع الجنين بأي حال من الأحوال. وأوصت الدراسة المقنن الجزائري بضرورة تدارك مسألة الكشف عن نوع الجنين بما يتفق مع ما أوجبته الشريعة الإسلامية في هذا الشأن، وبما يعزز الحماية القانونية لنوع الجنين The study aimed at exploring the legal protection of the gender of the embryo according to the Algerian legislation the light of the Islamic Law. The study administered the descriptive comparative approach. A review of literature was conducted. The study reached the following findings; first, the Algerian legislation pays no attention to the issue of examining the gender of the embryo and this breaches the most supported opinion in Islamic Jurisprudence that the examination of the gender of the embryo is not permissible; second, the Algerian legislation agrees with the most supported opinion in Islamic Jurisprudence that the determination of the gender of the embryo is prohibited. It is recommended that the Algerian legislation ought to take the issue of the examination of the gender of the embryo into consideration and to tackle it in accordance with what Islam prescribes in this matter.
