أحكام منازعات التحويل الدولي للأموال

Résumé: إن تطبيق قواعد الاختصاص القضائي في منازعة البنوك كونها قواعد وطنية وجدت لتحكم معاملات تبرم وتنفذ في العالم المادي، الأمر الذي جعلها عاجزة عن حكم المعاملات البنكية الدولية التقليدية عموما والإلكترونية خاصة وعلى وجه الخصوص التحويل المصرفي. كما يتجلى أيضا أن تحديد القانون الواجب التطبيق على العلاقات العقدية ذات الطابع الدولي الخاص يتنازعه منهجان: المنهج الأول والذي يتمثل في قاعدة التنازع التقليدية، والثاني منهج القواعد الموضوعية، وتبين أن كلاهما لم يستطيعا تحديد القانون الذي يحقق الحماية الكافية للطرف الضعيف في العلاقة ذات الطابع الدولي، خصوصا في العمليات المصرفية الإلكترونية، ومنها التحويل المصرفي الإلكتروني. The application of jurisdiction rules in a banking dispute is clearly national rules that exist to govern transactions concluded and implemented in the physical world, rendering them incapable of governing traditional international banking transactions in general and electronic in particular, like banking transfers. It is also evident that the determination of the law applicable to complex relationships of a particular international character is disputed in two approaches: The first is the rule of traditional conflict, the second is the objective approach of rules, and both have not been able to determine which law provides adequate protection to the weak party in the international relationship, particularly in electronic banking operations, including electronic banking transfer.
