المسؤولية الجزائية عن نقل الأمراض الوبائية إلى الغير وفقا للقانون الجزائري

Résumé: يعتبر حق الإنسان في سلامته الجسدية من الحقوق الأساسية المكرسة في الدستور الجزائري، وقد أصبح بحاجة ملحة إلى حماية قانونية شاملة في ظل انتشار الأمراض الوبائية المعدية والخطيرة. و قدمت هاته الدراسة عن موقف القانون الجزائري بالنسبة لمسألة قانونية هامة ترتبت عن نقل عدوى هاته الأمراض، حيث بحثنا في المسؤولية الجزائية التي تطال الشخص الذي يعلم أو يجب أن يعلم بأنه حامل للمرض الوبائي، ومع ذلك لا يلتزم بواجب العناية تجاه أسرته والمجتمع ككل، وكذا مدى التزام ممارسي الطب المعالجين لشخص حامل للمرض بواجب تحذير مرضاهم اتجاه الغير، في ظل مستجدات التجريم العام الذي جاء به قانون العقوبات الجديد رقم 20-06 المؤرخ في 28/04/2020 بشأن تعريض حياة الغير وسلامته الجسدية للخطر. Abstract: The human right to physical integrity is considered one of the fundamental rights enshrined in the Algerian constitution, and it has become an urgent need for comprehensive legal protection in light of the spread of serious infectious and epidemic diseases. This study presented the position of the Algerian law regarding an important legal issue arising from the transmission of these diseases, as we discussed the criminal responsibility of the person who knows or should know that he is a carrier of the epidemic disease, yet he does not adhere to the duty of care towards his family and society as a whole, as well as The extent of commitment of health practitioners treating a person carrying the disease to the duty to warn their patients towards others, in light of the New general criminalization brought in by the new Penal Code No. 20-06 of 28/04/2020 of endangering the life and physical integrity of others.
