امكانية ابراء اختراعات التكنولوجيا الحيوية : لقاح فيروس كوفيد19- أنموذجا .

Résumé: يتعلق البحث بموضوع التقدم في مجال الكائنات الحية، عن طريق التعديل الوراثي، وقد تبين ذلك بوضوح مع ظهور فيروس كوفيد19، حيث تم البحث في المادة الجينية له من أجل التوصل إلى لقاح، ونهدف إلى تسليط الضوء على منح براءة الاختراع لمختلف مجالات التكنولوجيا الحيوية، ومعرفة ما إذا كان التوسع في إبراء هذه الاختراعات احتكار؟أم تشجيع على الابتكار؟ وقد اعتمدنا في ذلك المنهج التحليلي، من خلال تحليل مختلف النصوص القانونية المتعلقة بهذا المجال . وأمام هذا الوضع نستنتج أن الدول الكبرى تسعى إلى التوسع في نطاق منح براءة الاختراع لمختلف الاختراعات الحيوية، في حين تبقى الدول النامية تعاني من التبعية نتيجة استيرادها للأدوية واللقاحات بأسعار باهظة. The research is about progress in the domain of living organisms, their development through genetic modification, which has been clearly confirmed with the appearance of covid 19- virus, where its genes have been used to find an effective vaccine for it, we also aim to highlight patent grants to various areas of biotechnology, and to see whether expansion of patent grants is a monopoly?, or an innovation encourage? we have used the analytical methodology by analyzing various legal texts related to patent grants in the biotechnology . In the Face of this situation, we conclude that the major powers are seeking to expand the patent grants to various vital inventions, when the developing are still suffering from dependency as a result of the importation of medecins and vaccines at high prices.
