Responsibility Of Smart Contract Parties In Algerian Legislation

Résumé: العقود الذكية هي ببساطة برامج مخزنة على المنصة الرقمية "البلوك تشين" والتي يتم تشغيلها عند تحقق شروطها المحددة مسبقًا، والهدف منها هو تبسيط الأعمال والتجارة بين الأطراف المحددة على المنصة الرقمية دون الحاجة إلى الوسيط التقليدي، وهذا يحد من حدوث الخطأ العاقدي ويقلل من تكاليف تنفيذ العقد، دون المساس بالأصالة والمصداقية. في هذا المقال العلمي سوف نتطرق إلى ماهية تقنية البلوك تشين من جهة، وإلى المسؤولية المدنية لأطراف العقد الذكي، وموقف المشرع الجزائري من ذلك. Smart contracts are simply programs stored on a blockchain that run when predetermined conditions are met. On blockchain, the goal of a smart contract is to simplify business and trade between both anonymous and identified parties, sometimes without the need for a middleman. A smart contract scales down on formality and costs associated with traditional methods, without compromising on authenticity and credibility. What is the civil liability of the parties to the smart contract? What is the Algerian legislator’s position on these contracts? This is what will be discussed in this article.
