إشكالية التنازل عن السكنات الاجتماعية الوظيفية قراءة في أحكام المرسوم التنفيذي رقم 06-208 والنصوص ذات الصلة

Résumé: يرتبط السكن الوظيفي ارتباطا وثيقا بالوظيفة التي تعتبر الأساس القانوني والفعلي لشغله أو استحقاقه,وبين مجرد شغل السكن الوظيفي أو أحقيّة إستحقاقه وتملّكه،تثور إشكالية التنازل عن السكنات الوظيفية التي تختلف مناقشتها –أي اشكالية التنازل-بالنظر إلى أهميّة الوظيفة المطلوب شغلها وعلاقتها بحسن سير وانتظام المرفق العام و طبيعة السكنات المخصصة والشروط المطلوبة لإتمام التنازل من عدمه. تهدف الورقة البحثية المقدّمة إلى تسليط الضوء على بعض الإشكالات التي قد يثيرها تطبيق النصوص المنظّمة لذلك لاسيما المرسوم التنفيذي رقم 06-208 الذي يحدّد كيفيات تحويل حق إيجار السكنات ذات الطابع الاجتماعي المخصّصة للإدارات والمؤسسات والهيئات العمومية وتحديد ما إذا كانت الهيئات المسؤولة على تطبيقه قد استجابت لمضمون النص،بعد تحديد ماهية السكنات الوظيفية وطرق تخصيصها. Abstract: The functional housing is basically related to the function that is considered the legal and actual basis for his occupation or his entitlement, and between the mere occupation of the functional housing or his entitlement and ownership, the problem of assigning functional housing arises, the debate of which differs - the problem of assignment - given the importance of the job to be filled and its relationship to the smooth functioning and regularity of the facility, the nature of the housing allocated, and the conditions required to complete the assignment or not. This paper aims to shed light on some of the problems that may be raised by the application of the texts regulating this issue, especially Executive Decree No. 06-208, which specifies the modalities for transferring the right to rent housing of a social character intended for public administrations, institutions and bodies and determining whether the bodies responsible for its implementation have responded to the content the text, after defining what the functional housing is and the methods for its allocation
