Résumé: Both Islamic jurisprudence and Algerian legislation imposed penal protection for the Islamic religion, They differed in their concerns in this protection, and the extent to which it was achieved in the preservation of religion. Islamic jurisprudence has made the subject of such protection a necessity of life.There are explicit legal provisions that end the abuse of religion in its ideological origins, rituals or sanctities. Scholars agree that religion must be preserved, because they consider religion crimes to be one of the greatest and most dangerous crimes in societyand because most of its images are positive for kufr and apostasy unlike the Algerian legislator who failed to achieve this protection, despite the great importance that religion has received in the Algerian legislation which is the basis for the preservation of public order and a symbol of national identity. The failure is manifested by the elements of criminalization and punishment. In terms of criminalization: some acts that are offensive to religion are criminalized while others were ranked as second-in-a-kind for crimes and considered asmisdemeanours. In terms of punishment: the punishment prescribed for these crimes did not limit their repetition, they are also disproportionate to the status of the Islamic religion.
