الطبيعة القانونية لعقود البناء والتعمير في التشريع الجزائري
Résumé: من خلال دراستنا لهذا الموضوع يتضح لنا أن المشرع الجزائري قد أولى اهتماما كبيرا لمسألة التهيئة العمرانية، وذلك من خلال تحديده لعدة آليات لتنظيم المجال، ويظهر ذلك من خلال فرض الرخص والشهادات وتقييدها بجملة من الإجراءات فهو يهدف من وراء ذلك إلى ضمان احترام قواعد التهيئة والتعمير ومراقبة النشاطات العمرانية، كما تهدف الرخص الإدارية إلى الحفاظ على النظام العام العمراني وجمال الرونق، فهي كلها تدخل ضمن عناصر النظام العام. الكلمات المفتاحية:المشرع، التهيئة العمرانية، الرخص، الشهادات، النشاطات العمرانية، النظام العام. Abstract: Th rough Our study of issue, itbecomes clear to us that the Algerian legislator has paidgreat attention to the issue of urbandevelopment, by defliningse veralmechanisms to regulate the field, andthisise videntthrough the imposition of licenses and certificates and their restriction of a set of procedures, as itaimsfrom behindthat to ensure respect for the rules of preparation, reconstruction and monitoring Urbanactivities, as well as the administrative licensesaim to preserve the urban public order and the beauty of luster and rawaness, as they are all part of the elements of public order.
