الحماية القانونية للبيئة في إطار القانون الدولي والتشريع الجزائري

Résumé: يتناول موضوع البحث الموسوم بالحماية القانونية للبيئة في ظل القانون الدولي والتشريع الجزائري، دور مختلف الهيئات الدولية سواء أكانت منظمات حكومية متخصصة أو غير حكومية أو إقليمية بالإضافة إلى الهيئاتالوطنية. وقد أبرزنا في هذه الدراسة أهم المؤتمرات التي أولت اهتماما كبيرا بالبيئة،كما تم التطرق في هذا العمل أيضا إلى دور المجتمع المدني في تحقيق الأمن البيئي وإدارة البيئة، واشرنا أيضا إلى مصطلح التربية البيئية وما يندرج تحتها من ميكانيزمات. وأوضحنا كذلك تأثر الجزائر بالسياسة البيئية الدولية ومشاركتها في مختلف المحافل الدولية ذات الصلة بالبيئة والتنمية المستدامة ومصادقتها على جل الاتفاقيات الدولية البيئية. كما ذكرنا الهيئات الإدارية المركزية و اللامركزية والهيئات المستقلة المكلفة بحماية البيئة في الجزائر حسب قانون البيئة . واستخلصنا من هذه الدراسة أن حماية البيئة تستند على مختلف الفواعل الدوليةوالإقليميةو الوطنيةوالجمعيات البيئية. وبالتالي يستوجب تكاتف وتضافر جميع الجهود من اجل بيئة سليمة صالحة للعيش. Abstract The topic of the researchis about the legal protection of the environmentunder international law and Algerian legislation, deals with the role of various international bodies, whetherthey are specialized in governmental, non- governmental or regionalorganizations in addition to national bodies. In thisstudy, wehighlighted the most important conferencesthatpaidgreat attention to the environment. Wealsodiscussed in thiswork, the role of civil society in achievingenvironmentalsecurity and environmentalmanagement . Wealsoreferred to the termenvironmentaleducation and the mechanismsthatfallunderit. Wealsoexplained , The influence of international environmentalpolicy on Algeria, and thatwasevident in its participation in various international forums related to the environment and sustainabledevelopment, and its ratification of most international environmental conventions. We have alsomentionedcentralized and decentralized administrative bodies and Independent commissions in charge of environmental protection in Algeriaaccording to the Environmental Law. Weconcludedfromthisstudythatenvironmental protection isbased on various international, regional and national actors and environmental associations. Therefore, itrequiresconcerted efforts for a healthy and livableenvironment
