المستحدث في الحماية القانونية للطفل مدمن المخدرات، قراءة في القانون رقم 23-05

Résumé: تهدف هذه الورقة البحثية لتحقيق تحليل قانوني لمختلف التدابير المستحدثة لحماية الطفل مدمن المخدرات أو المؤثرات العقلية، والوقوف على مدى فاعليتها في تحقيق الوقاية من إدمان الحدث للمخدرات أو المؤثرات العقلية، وعلاجه بما يضمن حقوقه كطفل، وكفئة تعد الأكثر من بين شرائح المجتمع عرضة للأخطار والتهديدات، نظرا لخصائصهم النفسية والذهنية والجسدية الهشة. وقد خلصت هذه الدراسة إلى أن التعديلات التي أوردها المشرع الجزائري بموجب القانون 23-05 عالجت العديد من النقائص التي اعترت القانون 04-18 المتعلق بالوقاية من المخدرات والمؤثرات العقلية وقمع استعمالها والاتجار المجرم بها بصفة عامة، والطفل المدمن بصفة خاصة. This research paper aims to achieve a legal analysis of the various innovative measures introduced to protect drug and psychotropic substances addicted child, and to determine their effectiveness in achieving prevention from drug and psychotropic substances, and the child treatment to ensure his rights as a child, and as a category that is considered the most vulnerable among the segments of society to dangers and threats, due to their fragile psychological, mental and physical characteristics. This study concluded that the Algerian legislature's amendments under law No. 23-05 addressed many of the shortcomings of law No. 04-18 on the prevention of drugs and psychotropic substances and the repression of their use and trafficking in general, and with a drug-addicted child in particular.
