طبيعة مسؤولية الطبيب المدنية عن عمليات نقل وزرع الأعضاء البشرية.

Résumé: الملخص: تشمل قواعد ممارسة مهنة الطب أخلاقيات تفرض على ممارسيها الاستقامة في السلوك مع المرضى والرأفة بهم، و احترام الواجب المهني في جميع الظروف و الأحوال. فالطب الحديث، طب عرف بانجازاته المذهلة كالتلقيح الاصطناعي، الهندسة الوراثية، الاستنساخ، عمليات تغيير الجنس، التعقيم كأسلوب علاجي و عمليات نقل وزرع الأعضاء البشرية، و هذه الأخيرة هي من أهم الانتصارات التي عرفها ميدان الطب و التي تتلخص في كون أنها عمليات يتم بموجبها نقل عضو سليم من أعضاء جسم شخص حي أو ميت وزرعه في جسم آخر هو في حاجة ماسة إليه. و للوقوف عند أسرار هذه العمليات و مصالحها، فإنه يكون لزاما على القانون أن يساير هذا التطور ويواكبه، و من ثم الوقوف عند التنظيم القانوني و الإداري لهذه العمليات، و تحديد نطاق مسؤولية ممارسيها وهم الأطباء. الكلمات المفتاحية: نقل الأعضاء، زرع الأعضاء، مسؤولية الطبيب المدنية، المسؤولية العقدية. Abstract: The codes of professional conduct and codes of practice of Medicine profession include ethical behaviours Code. The code is embodied in various Codes of Ethics, applicable to all practitioners to meet the ethical challenges of medical practice with patients and respect for the professional duty in all circumstances and situations. In this sense, it has become essential, due to consequence of the development of modern medicine, such as artificial insemination, genetic engineering, cloning, sex change, sterilization as a method of treatment, and transplantation of human organs in which an organ is removed from a living or deceased person into another person who most urgently needs, to study all the aspects and identify the secrets and purposes of such operations. It has therefore incumbent on the legislature to amend the laws in order to keep pace with developments, so as to identify legal and administrative regulations that have a large influence on those players and their interactions involving these operations, and this in turn determines the scope of responsibility of practitioners, namely, the doctors.
