المعنى بين التصريح والتضمين عند علماء الأصول

Résumé: الملخص: تُعدُّ جدلية المعنى قضية جوهرية عند الأصوليين، فالاختلاف في طرق إدراك المعنى هو اختلاف في الأحكام الشرعية، فلقد اعتمد الاتجاه الظاهري على المعنى الحرفي للنص، وفي هذا مقاربة لسانية للمدارس الشكلية الصورية التي تجعل النص منغلقا على نفسه، كما اعتمد الاتجاه المقاصدي على قصدية الخطاب لتحقيق مصالح النّاس، وفي هذا مقاربة لسانية تداولية تتجاوز الوضع اللغوي لتبحث في مجال الاستعمال اللغوي الذي يعنى بالمكونات اللغوية وغير اللغوية لإدراك المعنى المراد. :Abstrac The argument about the meaning issues was at the heart of the debate among given that diversity in the tools to reach meaning leads necessarily to diversity in verdicts arising out of them. Advocates of explicitness resorted to the literal meaning of texts, resembling the formal/structural linguistic schools which take texts as self-contained. Meanwhile, advocates of the intentionality sought to uncover the intended meaning of texts in an attempt to consider people’s interests, which is considered as a linguistic pragmatic approach. This latter went beyond the linguistics proper towards language use and utilized both linguistic and non-linguistic components to reach the intended meaning.
