أثر جائحة كوروناcovid_19 ‎‏ على الآجال الإجرائية ‏ ‏(دراسة على ضوء القانون رقم 08_09 المتضمن قانون الإجراءات المدنية والإدارية)‏

Résumé: شهدت دول العالم في الآونة الأخيرة ثورة بيولوجية والمتمثلة أساسا في جائحة فيروس كورونا ‏‏(‏covid_19‎‏)، والذي بدأ ظهوره في الصين ديسمبر 2019، ومن ثمة بدأ يتفشى في العديد من دول ‏العالم. وفي 30 جانفي 2020 أعلنت منظمة الصحة العالمية أن عدد الاصابات شكلت حالة طوارئ ‏صحية عامة خلقت نوعا من الفزع والخوف في جميع أنحاء العالم، بما فيها الجزائر. حيث أنه بتاريخ ‏‏12 مارس 2020 أمر رئيس الجمهورية الجزائرية عبد المجيد تبون باتخاذ إجراءات وتدابير وقائية للحد ‏من تفشي الوباء من بينها تعليق جل الأعمال، وبالتالي فإن آثار جائحة كورونا (‏‎(covid_19‎‏ امتد إلى تعليق ‏أعمال الجهات القضائية والسير العادي لمرفق العدالة، ما ينجر عن ذلك المساس بحقوق المتقاضيين ‏خاصة منها الإجرائية، وبصفة خاصة الآجال(المواعيد) الإجرائية والتي هي محل بحثنا هذا.‏ The countries of the world have recently witnessed a biological revolution mainly ‎represented by the covid‏ ‏ ‎-19 virus, which started up from china in December 2019, and from ‎there it started to spread in many countries of the world. On January 30, 2020, the World ‎Health organization has announced that the number of injuries constituted a public health ‎emergency that created a form of panic and fear throughout the world, including ‎Algeria. Whereas, on march 12,2020, the President of Algerian Republic, Abdel Majid ‎Tabboune, has ordered to take preventive procedures and measures to limit the spread of the ‎epidemic, including the suspension of most actions, the effects of the corona pandemic ‎covid-19 extended to the suspension of the work of judicial authorities and the normal ‎functioning of a facility justice, what drags, a prejudice to the rights of litigants, especially ‎procedural ones, in particular deadlines procedure which is subject of our research.‎
