انعكاسات فيروس كورونا كوفيد 19 على تسريح العمال

Résumé: إن علاقة العمل من الناحية القانونية تنظمها قوانين العمل، و التي تسعى لوضع الضمانات الكافية لتوفير بيئة عمل سليمة للجميع، ولمن مع انتشار جائحة كورونا – كوفيد 19- في جميع أنحاء العالم ظهرت عدة إشكالات في بعض المجالات وخاصة الاجتماعية والقانونية، وخاصة مع إعلان حالة الطوارئ وفرض الحجر الصحي على المواطنين اثر سلبا على علاقات العمل بحيث أصبح تنفيذ الالتزامات مستحيلا فنتج عن ذلك غلق المؤسسات و إيقاف عقود العمل مؤقتا او إنهائها وبذلك تسريح العمال. الجدير بذلك أن تسريح العامل لا يتم إلا إن كانت هناك أسباب قانونية لتطبيقه حتى لا يكون تعسفيا هذا ما يدعونا للبحث عن التكييف القانوني لجائحة كورونا، وحسب ما جاء في الشريعة العامة للقانون الخاص القانون المدني فهي تعد قوة قاهرة لما يكون تنفيذ الالتزام مستحيلا أما إن كان مرهقا للعامل الأجير فهي ظرف طارئ. Employment relationship is legally regulated by labor laws whish establish adequate guarantees to provide a healthy working environment . however , with the spread of the corona virus pandemic, several problems emerged in the social and legal fields, especially after the state of emergency was declared and the quarantine was imposed, which negatively impacted employment relationships and resulted in the closure of companies temporary suspension or termination of employment contracts and thus layoffs. It should be noted that employee dismissal must not occur unless there are legal reasons so as not to be arbitrary. We will try to find the legal adaptation of the corona virus pandemic since the civil law considers it as a force majeure when the fulfillment of obligations is impossible and as an emergency when it is burdensome
