Résumé: ملخص: هذه الدراسة تتناول نوعا خاصا من القواعد الأصولية تمتاز بصياغتها المصدرة بكلمة (كل) المسمّاة (الكليات الأصولية)، وبيان أثرها في توجيه دعوات التجديد الأصولي التي تظهر من حين لآخر، مما يعين على ضبط مسار التجديد، فحاولنا الإجابة عن مدى التأثير الذي تحدثه تلك الكليات في ضبط التجديد من خلال واحد من أعلام الأصوليين وهو الشاطبي، بغية الوصول إلى طرائق الأئمة في التقعيد و التجديد، معتمدا على المنهج الوصفي في بيان مفهوم الكليات، والتحليلي في دراسة نماذج من كليات الشاطبي المتعلقة بجانب النخل والغربلة الأصولية، وقد خلصنا إلى أن الأئمة منذ العصور المتقدمة يستعملون الكليات الأصولية في كلامهم لكن لم تظهر في صورة فن تقعيدي مستقل إلا في عصرنا، فتبيّن في هذه الدراسة معالمُها، وما تفترق به عن سائر فنون القواعد، كما تبيّن أن علم أصول الفقه دخل فيه مسائل ومباحث ليست من صميمه، فاتجه كثير من المحققين ومنهم الشاطبي إلى وضع معايير لتنقيته - بعضها على شكل كليات-، مما يساعد على جعل هذا العلم عمليا وظيفيا، محققا للغرض من وضعه، وذلك بالإشارة إلى وجوب مراعاة قصد الشارع، بعيدا عن فضول المسائل والمناقشات. Abstract: This article tackled a special type of fundamental rules which begin with the word "Evry", and clarified their impact on guiding the fundamentalist renewal to make it acceptable. the study attempted to answer the question of whether these special rules can contribute in regulating the path of renewal, and the extent of Al-Shatibi's contribution in this aspect. We aimed to understand the methods of scientists in setting rules and renewing them. A descriptive analytical approach was adopted to study examples of Al-Shatibi's rules related to filtrate jurisprudence's principles from the intruder. As a result, an explanation of the concept of special fundamentalist rules and how scientists used them before they became an independent art was reached, including al-Shatibi especially in filteration process to make it practical away from mere curiosity and debate.
