الحق في التنوع الثقافي في القانون الدولي المعاصر

Résumé: الملخص باللغة العربية: التنوع الثقافي حق مهم من الحقوق الثقافية التي يكفلها القانون الدولي المعاصر، حيث تتمحور دراستنا حول إبراز ماهية هذا الحق المكانة التي يحتلها ضمن الحقوق الثقافية ككل، إذ نتوقع أن تقارب مكانة الحق في الحياة بالنسبة لباقي حقوق الإنسان لأن الهدف هو إثبات أهميته لكل الثقافات لأنه يضمن لها حق الحماية والتنمية، ومبدئيا التنوع الثقافي هو تعدد أشكال وأساليب التعبير عن التراث الثقافي وثراءه ونقله، وكذلك يتجلى في تنوع وإبداع أشكال التعبير الفني وإنتاجها ونشرها والتمتع بها وتوزيعها بغض النظر عن التكنولوجيات المستعملة في ذلك، كما اتضح بدراسة الوثائق القانونية الصادرة عن منظمة اليونسكو وفي مقدمتها الإعلان بشأن التنوع الثقافي لعام 2001 الذي وضع الأسس القانونية اللازمة للإقرار هذا الحق وضمان اعتراف الدول به. Abstract: Cultural diversity is an important cultural right guaranteed by contemporary international law, as our study focuses on highlighting the nature of this right and the position it occupies within cultural rights as a whole, as we expect that the status of the right to life will approximate in relation to the rest of human rights because the goal is to prove its importance For all cultures, because it guarantees them the right to protection and development. In principle, cultural diversity is the multiplicity of forms and methods of expression, richness and transmission of cultural heritage. It is also reflected in the diversity and creativity of artistic expressions, their production, dissemination, enjoyment and distribution, regardless of the technologies used in this, as evidenced by the study of legal documents issued by UNESCO, foremost of which is the Declaration on Cultural Diversity of 2001, which laid the necessary legal foundations for recognizing this right and ensuring its recognition by states
