ممارسة مهنة الصحافة بين الضوابط القانونية والمسؤولية الأخلاقية في التشريع الجزائري

Résumé: تهدف هذه الورقة البحثية إلى تسليط الضوء على الضوابط القانونية والمسؤولية الأخلاقية لممارسة الصحافة في ظل التشريع الجزائري، والتي منحت الصحفي حقوق مقابل التزامه بواجب الامتثال لأخلاقيات المهنة الصحفية وألزمته التقيد بالقواعد القانونية، وهذه الأخيرة تمثلت في عدم المساس بالمبادئ العامة للدولة والمجتمع والنظام العام واحترام حقوق وحريات الأفراد، إضافة إلى ذلك النصوص التنظيمية التي ألزمت الصحفي بإتباع مبادئ المسؤولية الأخلاقية إنطلاقا من ضميره المهني والمسؤولية الاجتماعية تجاه مجتمعه، كما توصلنا من خلال قراءة في قانون الإعلام 12-05 إلى أن ممارسة مهنة الصحافة مكفولة دستوريا وقانونيا، تضمن نشاط وحماية المهنة الإعلامية مقابل تنفيذ الصحفي لأحكام قانون الإعلام 2012 الذي وضح في نصوصه وسائل وأدوات العمل الصحافي وأخلاقياته بما يضمن حرية الصحفي، ويضبط ممارسته الإعلامية لتحقيق أداء صحفي نزيه . This paper aims to highlight legal controls and ethical responsibility for the practice of the press under Algerian legislation, which granted the journalist rights in return for his obligation to comply with the ethics of the journalistic profession and obliged him to abide by legal rules. The latter was not to prejudice the general principles of the State, society, public order, respect for the rights, and freedoms of individuals. In addition, the organizational texts obliged the journalist to follow the principles of ethical responsibility based on his professional conscience and social responsibility towards his society. We have also concluded through a reading in the Media Law 12-05 that the exercise of the journalism profession is constitutionally and legally guaranteed. Also the implementation by the journalist of the provisions of the Media Law of 2012, which set forth in its texts the means, tools, and ethics of journalistic work in order to guarantee the journalist's freedom and regulate his media practice in order to achieve an impartial press performance.
