الآثار الإيجابية و السلبية لتطبيق الأحكام القضائية الدولية الجنائية على تحقيق السلم و الأمن الدوليين

Résumé: يقوم القضاء الدولي الجنائي بمحاكمة الأشخاص المتهمين بارتكاب جرائم دولية ، يعاقب عليها القانون الدولي أمام المحكمة الجنائية الدولية بموجب نظامها الأساسي، وعند إصدار أحكام قضائية وجب تنفيذها على ارض الواقع حتى يكون المحكوم عليه بصفة نهائية عبرة لغيره، من أجل الحد من انتهاكات القانون الدولي الإنساني مستقبلا. إلا أن تطبيق هذه الأحكام القضائية يحتاج للكثير من الإمكانيات المادية وأهمها مكان تنفيذ العقوبة، حيث أن المحكمة لا تملك مكان مخصص لها لتنفيذ هذه الأحكام، مما جعل تنفيذها يكون في دول أخرى وهو ما أثر تطبيق القانون الدولي الإنساني، إيجابيا وسلبيا، وبالتالي التأثير على تحقيق السلم و الأمن الدوليين في العالم. The international criminal judiciary tries persons accused of committing international crimes punishable by international law before the International Criminal Court in accordance with its statute, and when judicial rulings are issued that must be executed on the ground so that the final convict is a lesson to others, in order to reduce violations of international humanitarian law in the future . However, the application of these judicial rulings needs a lot of material capabilities, the most important of which is the place of execution of the punishment, as the court does not have a place designated for it to implement these judgments, which made their implementation in other countries, which is the impact of the application of international humanitarian law, positive and negative, and thus affect the investigation International peace and security in the world.
