النظام القانوني لمتابعة وتمثيل الأشخاص المعنوية عن الجرائم الخطيرة في التشريع الجزائري

Résumé: إن إقرار المشرع للمسؤولية الجنائية للأشخاص المعنوية في قانون العقوبات بصفة عامة ولمسؤوليتها عن الجرائم الخطيرة بصفة خاصة ألزم عليه وضع جملة من التعديلات التي تتماشى وطبيعة هذه الأشخاص. بدأً بتكييف القواعد العامة التي تحكم الاختصاص المحلي والنوعي للجهات القضائية وذلك بإحداث ما يسمى بالأقطاب الجزائية المتخصصة. ثم إن الشخص المعنوي لما كان مجرد افتراض لا يمكنه التصرف إلا بواسطة أعضائه أو ممثليه فقد خص المشرع بعض الأشخاص على سبيل الحصر لتمثيله و الدفاع عنه أمام القضاء. The recognition by the legislator of the criminal liability of legal persons in the penal code in general and of their liability for the offense of money laundering in particular has obliged it to introduce a series of amendments in accordance with the nature of these persons. Starting with the adaptation of the general rules which govern the local and specific competence of the judicial authorities, by creating the so-called specialized penal poles. Moreover, when the legal person is only a hypothesis, it can act only through its members or representatives, the legislator has designated certain persons exclusively to represent and defend it before the courts
