عيون أفكار العلامة محمد بن الحسن الحجوي في مقاصد الشريعة
Résumé: ملخص البحث يتولى البحث إماطة اللثام عن فكر العلامة محمد بن الحسن الحجوي في مقاصد الشريعة من خلال كتابه الشهير: (الفكر السامي في تاريخ الفقه الإسلامي). حيث نجده يخوض في قضايا كثيرة مقاصدية، على غرار المتقدمين. ويحرر مجموعة من قواعد هذا الفن، من شأنها أن تبوئه مكانة مرموقة ضمن علماء مقاصد الشريعة المعاصرين؛ كمحمد الطاهر بن عاشور وعلال الفاسي وغيرهما. كما سعى البحث إلى إيراد طائفة من تعليلاته لبعض الأحكام الشرعية؛ يظهر منها تمكن الرجل من الغوص على أسرار الشريعة، واكتناه حكمها. Abstrat The study aims to divulge the thought of the scholar Mohamed Ben Al-Hasan Al-Hajouiconcerning the purposes of jurisprudence, based on his well-known book (Noble Thought in the History of Islamic Jurisprudence). In this treatise we find him delving in multiple purpose-related issues, following his predecessors. He elaborated a set of rules for this art. Rules that promise to give it a prestigious status among contemporary scholars that specialize in this field, such as Ibn Ashour and Allal Al-Fassi and others. The paper also aims to discuss a range of his justifications for jurisprudence provisions that show his competence in Islamic laws and a command of its rules.
