معايير الكفاءة الأساسيّة بين الزّوجين في الفقه الإسلاميّ ومتغيّراتها

Résumé: ملخص يعدّ عقد الزواج من أهمّ العقود التي يبرمها المرء في حياته، لذلك تجده حريصا في اختياره للطّرف الثّاني بما يحقق نجاح الرابطة الزوجية بينهما، ومن هنا جاء موضوع الكفاءة في الزواج، والذي عنت به الشريعة الإسلامية أيّما عناية، فوضعت له معايير وصفات محددة. وقد تناولت الدراسة الحالية المعايير الأساسية والمتمثلة في الدّين والنّسب والحرفة والمال، كما تعرضت إلى المعايير المستحدثة كالتّحصيل العلميّ، والسلامة من العيوب والسنّ والبلد، وتم عرض المعايير استنادا إلى آراء الفقهاء في هذا المجال مع توضيح اختلافاتهم في تحديد اعتبار هذه المعايير، بين مضيّق وموسّع، ثم الإتيان بالراجح منها استنادا إلى قوة تلك الأدلة وتوافقها مع الشريعة الإسلامية السمحة. الكلمات المفتاحية: الكفاءة في الزواج، معايير الكفاءة، المعايير الأساسية، المعايير المتغيرة. Abstract : A marriage contract is one of the most important contracts that a person makes in his life, so in choosing his partner he based on specific criteria. The Islamic Sharia took care of marriage and its conditions, she set specific criteria and attributes for it, to achieve its goal, hence our interest in the subject of competence in marriage, as the current study dealt with the essential criteria; represented in religion, lineage, profession, and money, and the new criteria such as educational attainment, safety, age, and country, by presenting the opinions of the jurists with an explanation of their differences in determining the consideration of these criteria, and then weighting the opinion based on the strength of that evidence and its compatibility with Islamic law.
