مشروعية الاستفادة من الخلايا الجذعية - دراسة مقارنة -

Résumé: الملخص: يعتبر اكتشاف الخلايا الجذعية من أهم الاكتشافات العلمية الحديثة، حيث تتميز بقدرتها على التحول إلى مختلف خلايا الجسم، أين يمكن الاستفادة منها في علاج الكثير من الأمراض التي عجز الطب عن علاجها. غير أن استخدام هذه الخلايا أثارت آراء متباينة بين علماء الشريعة الإسلامية ورجال القانون حول الأساس الشرعي والقانوني الذي يستند عليه للاستفادة منها، بالإضافة إلى الضوابط الشرعية والقانونية التي يجب احترامها، باعتبار أن استعمال الخلايا الجذعية قد يمس بالكيان الجسدي للإنسان وحرمته. Abstract: The discovery of stem cells is one of the most important modern scientific discoveries, which are characterized by their ability to transform into various cells of the body, where they can be used in the treatment of many diseases that medicine was unable to treat. However, the use of these cells has raised different opinions among scholars of Islamic law and jurists about the legitimate and legal basis on which to benefit from them, in addition to the legal and legal controls that must be respected, given that the use of stem cells may harm the physical being of a person and his sanctity.
