مصير شرط التحكيم في عقود الإذعان عامة وعقد التأمين نموذجا

Résumé: التحكيم وسيلة إختيارية لحل المنازعات ، ولذلك فإن إدراج شرط التحكيم في العقود بإتفاق الطرفين أمر أجازه المشرع كأصل عام ، غير أن خاصية الإذعان في العقد قد تتعارض مع طبيعته الإتفاقية ، ذلك أنه من المحتمل أن يحمل وصف التعسف لإستغلال الطرف الضعيف في العلاقة مركزه الإقتصاده المتفوق عن طريق إملاء هذا الشرط على الطرف الآخر بإدراجه ضمن شروط العقد دون علم هذا الأخير ، ولذلك فقد خص المشرع أحكام تقيّد إرادة الطرف القوي في العلاقة بشروط تجنبه التعسف وأهمها تلك الواردة في القانون المدني في إطار محاربة الشروط التعسفية ، إضافة إلى ذلك منح القضاء الدور في حماية الطرف الضعيف في العلاقة .
