الطبيعة القانونية لعقد استغلال العقارات الوقفية الموجهة للاستثمار -دراسة في المرسوم التنفيذي لسنة 2018-

Résumé: ملخص: لم تكن الطبيعة القانونية لعقد استغلال العقارات الوقفية الموجهة للاستثمار واضحة المعالم وإنما تحتمل عدة تكييفات، ورغم ذلك غلبت على العقد عناصر عقد الإيجار لكنه يبقى ذو طبيعة خاصة،كما أنه عقد يجمع ما بين عقارات الوقف وعملية الاستثمار قصد إقامة مشاريع كبيرة تحقق فائض قيمة من شأنها تثمين أملاك الوقف والمساهمة في تحقيق التنمية المحلية . وقد ثبت على هذا العقد طبقا للمرسوم التنفيذي رقم 18/213، وجود بعض الأحكام القانونية التي تحتاج لإعادة نظر، تحقيقا لجوهر العقد في إطار المصلحة الفضلى لأملاك الوقف ،من جهة ،وبما يتناسب مع طبيعتها ويحقق مقاصدها ، من جهة أخرى، وتعبر خطوة أولية الاقتراحات التي سيتم محاولة تقديمها من خلال هاته الدراسة. It has been proven on this contract according to the executive decree n. 18/213, the existence of some legal provisions which need to be redress or review, in order to achieve or generate the essence of the contract, in the best interest of wakfs property, on the one hand, and commensurate with its nature and achieve its objectives, on the other hand, We have tried through this study Provide a Proposals as an initial step.
