الوقاية من الأضرار الناجمة عن المنشآت المصنفة لحماية البيئة في التشريع الجزائري

Résumé: ركز هذا المقال على فعالية الحماية التي كفلها المشرع الجزائري للوقاية من خطر نشاط المنشآت المصنفة، سواء من خلال الإجراءات الوقائية القبلية (من خلال فرض بعض الدراسات التقنية) أو اللاحقة عن استغلال المنشآت و كذلك الجزاءات الإدارية المنصوص عليها في القانون رقم 03-10 المتعلق بحماية البيئة في إطار التنمية المستدامة و المرسوم التنفيذي رقم 06-198، الذي يضبط التنظيم المطبق على المؤسسات المصنفة لحماية البيئة، لمعرفة مدى فعالية هذه الترسانة التشريعية على أرض الواقع في وضع حد لخطر المنشآت و تحقيق حماية فعالة للنظام البيئي. This article focused on the effectiveness of legal protection provided by the Algerian legislator to prevent against the danger of the activity of classified establishments, whether they are preemptive preventive measures (By imposing some technical studies),or after the exploitation of establishments, as well as the administrative sanctions stipulated in both law 10-03 on environmental protection in the context of sustainable development and executive Order 06-198 defining the applicable regulations to institutions classified for environmental protection to find out the effectiveness of this legal arsenal on the ground to put an end to the risk of these facilities and achieve effective protection of the ecosystem.
