دور القضاء وبعض الأجهزة ذات الصلة في مكافحة الفساد في التشريع الجزائري

Résumé: هذه الدراسة إلى التعرف على دور القضاء وبعض الأجهزة ذات الصلة في مكافحة الفساد في التشريع الجزائري، حيث تم الاعتماد على المنهج التحليلي وذلك بتحليل مختلف النصوص القانونية المتعلقة بموضوع الدراسة، وقد تم التوصل الى النتائج التالية: 1ــ إن المشرع الجزائري عمل على استحداث أصناف أخرى من جرائم الفساد والجرائم المرتبط بها والتي أنشأ لها خصيصا أجهزة قضائية جزائية متميزة، تتمثل في الجهات القضائية ذات الاختصاص الموسع أوما يعرف بالأقطاب القضائية المتخصصة ". 2ـــ إن دور القضاء في مكافحة الفساد في التشريع الجزائري يتنوع باختلاف نوع جرائم الفساد، فهناك جرائم تختص بها الجهات القضائية الجزائية العادية "التقليدية" وأخرى تختص بها الجهات القضائية ذات الاختصاص الموسع. 3ـــ إن المشرع الجزائري قد فشل في تحديد مصطلحات الفساد وتعريف جرائمه بدقة وضبط أسبابه المتشعبة وحصر أثاره المدمرة وفي رسم خطة مضبوطة أو إستراتيجية محكمة لمكافحة الفساد رغم محاولة استدراكه الأمر في التعديلات المتكررة لقانوني العقوبات ومكافحة الفساد، حيث يتضح ذلك من خلال إجراء مقارنة بسيطة بين الجرائم التي تختص بها الجهات القضائية الجزائية العادية والجرائم التي تختص الجهات القضائية ذات الاختصاص الموسع. This study aimed to identify the role of the judiciary and some of the relevant bodies in the fight against corruption in Algerian legislation. The analytical approach was based on analyzing the various legal texts related to the subject of the study. The following results were obtained: 1- The Algerian legislator has introduced other types of corruption crimes and related crimes, which have specifically created distinct criminal justice bodies, represented by judicial bodies with expanded jurisdiction or so-called specialized judicial poles". 2- The role of the judiciary in the fight against corruption in Algerian legislation varies according to the type of corruption crimes. There are crimes that are common to the regular "traditional" penal bodies and others that are specialized by the judicial authorities with expanded jurisdiction. 3- The Algerian legislator has failed to define the terms of corruption, define its crimes accurately, control its complex causes and limit its destructive effects, and draw up a well-planned plan or strategy to combat corruption, despite the attempt to remedy the repeated amendments to the penal code and the fight against corruption. This is illustrated by a simple comparison between the crimes of the ordinary criminal courts and those of the judicial authorities with the expanded jurisdiction.
