Résumé: عقد الامتياز هو من أهم العقود الإدارية التي تبرمها الدولة، ونظرا لمقوماته الاستثنائية فهو متميز عن العقود الادارية الأخر، فبالنسبة للإدارة المانحة فهدفه تخفيف العبء على الدولة، وبضمان الخدمة العمومية على أحسن وجه، ولضمان هذه الخدمة العمومية بالطريقة الحسنة لابد من الاختيار صاحب الامتياز. وبما أن عقد الامتياز عقد إداري، فهو يتميز بعدة خصائص تميزه عن العقود الأخرى بخصائص وبأركان متنوعة، فيجب على عقد الامتياز أن يتضمن وجوبا جهة إدارية ممثلة في الدولة أو الولاية أو البلدية، وأفراد أو شركات من جهة أخرى، وكذلك ينصب عقد الامتياز على إدارة أو استغلال أو إنشاء. يتم عقد الامتياز بموجب وثيقة رسمية تتضمن جميع الأحكام المتعلقة بعقد الامتياز، والتي تضعها الإدارة بإرادتها المنفردة، ويجب على المتلزم التقيد بها إذا رضي التعاقد مع الجهة الإدارية ومن كلا الطرفين المتعاقدين.necessarily include an administrative entity represented in the contry, municipality, individuals or companies in the other side,aswill as the concession contract focuses on managing, exloit, or construction. which concluded by the state, it is distinct from other administrative contracts due to its exceptional components.
