العلاقة السببية وفقا للفقه والتشريع والقضاء الاردني The Casual Relationship In Accordance To Jordanian Jurisprudence, Legislation And Jurisdiction

Résumé: في هذه الدراسة المتواضعة محاو لة لتحديد ماهية العلاقة السببية بين السلوك الإجرامي والنتيجة الجرمية المتحققة وأهميتها القانونية للجريمة مستخدما المنهج الوصفي التحليلي، وسرد لمضمون النظريات الفقهية التي سيقت لتوضيح معيار العلاقة السببية في حال تضافر عدة عوامل في إحداث في النتيجة الجرمية والانتقادات التي وجهت إلى كل منها، وموقف التشريع والقضاء الأردني من العلاقة السببية ومعيار علاقة السببية لدى القضاء الأردني في الجرائم المقصودة والجرائم غير المقصودة وعرض للاجتهادات القضائية لمحكمة التمييز الأردنية ذات العلاقة بهذه الدراسة وخلصت إلى مجموعة من النتائج والتوصيات ومنها يجب النص الصريح على منهج التشريع الأردني في معيار العلاقة السببية وكذلك استقرار القضاء الأردني على منهجية محددة في تحديد العلاقة السببية . This study aims to clarify the importance and the nature of the causal relationship that links criminal behavior with the criminal result. For this purpose, the researcher use the descriptive and analytical methodology to evaluate the criterion of causal relationship-in intended and unintended crimes- according to the doctrine of the Jordanian judiciary, besides examine Jurisprudential theories that discusses the causal relationship , especially when several acts causing the criminal result . In Conclusion, the researcher underlines several concluding -remarks. The most important is the need for a legislative intervention adopting a specific criterion for the casual relationship, which will lead to judicial stability regarding the causal relationship.
