Résumé: الملخص: تهدف الدراسة إلى توضيح جدلية العلاقة، بين الأمن القومي وحقوق الإنسان، في الولايات المتحدة الأمريكية ، بعد أحداث 11 سبتمبر 2001، وتحاول الإجابة عن إشكالية أساسية وهي كيف يمكن الحديث عن مكانة حقوق الإنسان، في ظل تزايد التهديدات الأمنية العابرة للحدود، والاهتمام بالأمن القومي من طرف الدول. لتصل في الأخير إلى كيفية الموازنة بين المصالح الأمنية الوطنية وحماية حقوق الإنسان، فلابد على صانع القرار أن يراعي في قيامه بالموازنة على الحجة الأكثر إلحاحا من أجل تحقيق هدف الجماعة و الأمن الوطني ووقاية المجتمع Abstract : The study aims to clarify the dialectical relationship between national security and human rights in the United States after the events of September, the 11th, 2001. The study is an attempt to answer a basic problem which is how you can talk about the status of human rights in the light of the increasing security transnational threats and, the concern of national security by the rest of the other countries. To reach in the fourth to how to balance between national security interests and the protection of human rights, The decision maker must take into account in his budget on the most compelling argument in order to achieve the goal of the group and the national security and protection of society
