الحماية التحفظية لحقوق الملكية الصناعية في القانون الجزائري

Résumé: الملخص تماشيا مع الاهتمام المتزايد بحماية حقوق الملكية الصناعية، عمل المشرع الجزائري على سن عدة قوانين ووضع جملة من الآليات القضائية من أجل توفير الحماية اللازمة لهذه الحقوق من مختلف أشكال الاعتداء عليها والتي يعتبر التقليد أبرزها، فشرّع لأصحاب هذه الحقوق رفع دعاوى التقليد والمنافسة غير المشروعة للحصول على الحماية الجزائية والمدنية الضرورية لحقوقهم. وإلى جانب ذلك فسح المجال واسعا أمامهم لاتخاذ ما يرونه مناسبا من التدابير التحفظية المنظمة سواء في القوانين الخاصة بحماية حقوق الملكية الصناعية أو غيرها من القوانين؛ وذلك من أجل حصر الضرر الناشئ عن الاعتداء على الحقوق الاستئثارية التي تمنحها لهم عناصر هذه الملكية، والحصول على الأدلة اللازمة وحفظها لإثبات الاعتداء، ثم استخدام هذه الأدلة عند رفع دعاوى التقليد أو المنافسة غير المشروعة. Abstract: In line with the growing interest in protecting industrial property rights, the Algerian legislator has enacted several laws and developed a set of judicial mechanisms in order to provide the necessary protection for these rights from various forms of abuse, of which counterfeit is the most prominent. The owners of these rights have the right to file a lawsuit concerning counterfeit and unfair competition, to obtain the necessary penal and civil protection for their rights.In addition, they have a wide scope to take what they deem appropriate from the regulated precautionary measures, whether in the laws relating to the protection of industrial property rights or other laws. This is in order to limit the damage resulting from the infringement of the exclusive rights granted to them by the elements of this property, and to obtain and preserve the necessary evidence to prove the infringement, and then use this evidence when filing counterfeit or unfair competition lawsuits.
