الطابع الإجتهادي للقضاء الإداري في ظل التوجهات الحديثة - دراسة تحليلية في ضوء التشريع والفقه المقارن-

Résumé: إن ميزة المنشأ القضائي للقانون الإداري هي، أكبر دليل يدفعنا إلى التفريق والتمييز بين القاضي الإداري و القاضي العادي، فالقاضي الإداري تخطى تطبيق القانون فقط. فمهمته الآن في ظل التوجهات الحديثة و المعاصرة للقضاء الإداري تتمثل في إنشاء وإبتكار القاعدة القانونية في حالات و وضعيات عدة، نبحث و نحلل في ضوء هذه الدراسة مساهمة القاضي الإداري في إرساء دولة القانون من خلال حقه في الإجتهاد القضائي على ظل التوجهات الحديثة للقضاء الإداري. The inability of the law، does not mean the inability of the judge، The advantage of the judicial origin of administrative law، the biggest proof that leads us to differentiate between the administrative judge and the ordinary judge. The administrative judge has passed being the law executor only، his task now under the modern trends of the administrative judiciary is to create and invent the legal rule in many situations. In this study، I looked closely at the contribution of the administrative judge in establishing the state of law through judicial jurisprudence in light of the modern orientations of the administrative judiciary
