واقع التحول نحو المحكمة الإلكترونية لإرساء و تطوير خدمات مرفق القضاء في الجزائر

Résumé: تهدف هذه الدراسة إلى إبراز تجربة الجزائر في مجال إنشاء و تطبيق المحكمة الالكترونية في مرافق القضاء وذلك باعتماد نظام التقاضي الالكتروني الذي يعد من أهم تطبيقات التطور التكنولوجي لاسيما في المجال الجزائي، بما يتناسب مع مستجدات العصر الرقمي و التكنولوجي من خلال إدخال التقنية الحديثة على خدمات مرفق القضاء لاسيما بصدور القانون رقم 15-03 المتعلق بعصرنة العدالة ،فما مدى فعالية التحول نحو المحكمة الالكترونية كآلية لإرساء و تطوير خدمات مرفق القضاء في الجزائر؟ حيث توصلنا من خلال هذه الدراسة إلى أن برنامج عصرنة قطاع العدالة الجزائرية و الإصلاحات التي حظي بها نتج عنها تحولات ملموسة في القطاع بتحسين خدمات مرفق القضاء و تقريب مرفق العدالة من المواطن ليتسم هذا الأخير بالجودة و الارتقاء ، و اعتمدنا في هذه الدراسة على المنهجين الوصفي التحليلي و القانوني لمعرفة الدور الفعال لتطبيقات المحكمة الالكترونية في قطاع العدالة الجزائري. This study aims to highlight Algeria's experience in the field of establishing and applying the electronic court in the judicial facilities, by adopting the electronic litigation system, which is one of the most important applications of technological development, especially in the penal field, in line with the developments of the digital and technological age through the introduction of modern technology to the services of the facility. The judiciary, especially with the issuance of Law No. 15-03 related to the modernization of justice, what is the extent of the effectiveness of the shift towards the electronic court as a mechanism for establishing and developing the services of the judicial facility in Algeria? Where we concluded through this study that the program of modernization of the Algerian justice sector and the reforms that it enjoyed resulted in tangible transformations in the sector by improving the services of the judicial facility and bringing the justice facility closer to the citizen so that the latter is characterized by quality and upgrading, and we relied in this study on the two descriptive and analytical approaches And legal to know the effective role of electronic court applications in the Algerian justice sector
