التحكيـــم التجاري الدولي كوسيلة بديلة لحل منازعات الاستثمار الأجنبي

Résumé: إن التطور الهائل في حجم الاستثمارات الأجنبية في الوقت الراهن، أدى بالعديد من الدول إلى البحث على أليات لحماية استثماراتها في الدول المضيفة، فلجأت هذه الأخيرة إلى تكريس التحكيم التجاري الدولي في قوانينها من أجل تشجيع الاستثمار الأجنبي، كما أبرمت عدة اتفاقيات دولية مع الدول المصدرة لرؤوس الأموال، كرست من خلالها ضمان اللجوء إلى التحكيم لحل منازعات الاستثمار، و الجزائر كرست التحكيم التجاري الدولي في قوانينها في إطار الضمانات الممنوحة للمستثمر الأجنبي، و ذلك بالرغم من وجود قضاء وطني يعود إليه الاختصاص الأصيل في تسوية كل النزاعات طبقا للقوانين المعمول بها.
