نظام تسليم المجرمين ودوره في مكافحة الإفلات من العقاب The Extradition System And Its Role In Combating Impunity

Résumé: يعتبر نظام تسليم المجرمين من بين أفضل الوسائل لضمان مثـول المتهم أمام القضاء وبالتالي تحقيق العقاب الرادع، إذ أن الدولة التي اُرتكِبت الجريمة على إقليمها أقدر على جمع الأدلة وإخطار الشهود وغير ذلك، كما يحقق التسليم المصلحة العامة، فبالنسبة للدولة المطالَبة فإنها بتسليمها المتهم تضمن أن إقليمها لم يعد ملاذا للمجرمين اللاجئين إليها يتحصنون به ضد العدالة، كما تضمن أن بتسليمها الشخص المطلوب ستعامل بالمثل مستقبلا، وبالنسبة للدولة الطالِبة فإن التسليم يمكّنها من ممارسة حقها في محاكمة من يحاول من الجناة الإفلات من العقاب. Abstract: The extradition system is the best way to guarantee that the accused will be tried and obtain a dissuasive sanction, the State in whose territory the crime is committed is more suitable for collecting evidence and serving witnesses,... etc. extradition is also aimed at achieving the public interest, The State whose extradition of the accused is requested ensures that its territory is no longer a haven for criminals who have fled there, this State also guarantees that by surrendering the wanted person, he will be treated reciprocally in future. For the State requesting extradition, extradition enables it to exercise its right to prosecute criminals who attempt to escape punishment.
