المسؤولية المدنية الجنائية للعنف المعنوي على الاطفال بين الشريعة الاسلامية و القانون الجزائري

Résumé: يعالج هذا البحث موضوع المسؤولية المدنية والجنائية للعنف المعنوي على الطفل بين الشريعة الإسلامية والقانون الجزائري، منطلقها إشكال أساسي هو: مامدى ضمان هذه المسؤولية في القانون الجزائري مقارنة بالشريعة الإسلامية؟ وقد قسمت موضوعي إلى ثلاثة مباحث؛ المبحث الأول بعنوان مفاهيم عامة حول المسؤولية المدنية والجنائية والعنف المعنوي للأطفال بين الشريعة الإسلامية والقانون الجزائري، والمبحث الثاني عنونته بأسباب وآثار العنف المعنوي وطرق الحد منه بين الشريعة الإسلامية والقانون الجزائري ، وأما المبحث الثالث فكان بعنوان الأحكام التطبيقية لحماية الطفل من العنف المعنوي في الشريعة الإسلامية والقانون الجزائري ، لأتوصل في الأخير لعدة نتائج؛ منها أن هذا النوع من العنف يعد أخطر من غيره لأنه داخل في تكوين الطفل وشخصيته."Abstract This research addresses the issue of civil and criminal responsibility for the moral violence against the child between Islamic sharia and Algerian law, its promise is a basic problem: What is the guarantee of this responsibility in Algerian law compared to Islamic sharia? I divided my topic intothree sections, the first topic is intitled General consepts about civil and criminal responsibility and moral violence for children between Islamic sharia and Algerian law ,and the second topic is titled with the causes and effects of moral violence and ways to reduce it between Islamic sharia and Algerian law , and thr third topic was titled with Applied provisions to protect the child from moral violence in Islamic sharia and Algerian law to reach in the end sesveral conclusions; including that this of violence is more dangerous than others because it is included in the formation and personality of the child. "
