جريمة اختلاس المال العام في ظل قانون الوقاية من الفساد ومكافحته

Résumé: الملخص: تندرج جريمة اختلاس المال العام ضمن جرائم الفساد المنصوص عليها في قانون الوقاية من الفساد ومكافحته، ونهدف من خلال هذا البحث إلى التطرق للأركان التي تقوم عليها هذه الجريمة والسياسة الجنائية التي انتهجها المشرع الجزائري في سبيل وضع حد لها نظرا لخطورتها، وتوصلنا في ختام بحثنا هذا إلى أنه يتعين تغليظ العقوبة على مرتكبي جريمة اختلاس المال العام نظرا لتمتع مرتكبيها بصفات معينة تفترض فيهم النزاهة باعتبارهم مؤتمنين على المال العام. الكلمات المفتاحية: اختلاس؛ المال العام؛ الموظف العمومي؛ المتابعة؛ الجزاء. Abstract: The crime of embezzlement of public money falls within the corruption offenses stipulated in the law on prevention and combating corruption, we aim through this research to address the pillars on which this crime is based and the criminal policy pursued by the Algerian legislator in order to put an end to it given its seriousness, At the conclusion of our research, we concluded that the perpetrators of the crime of embezzlement of public money should be punished more severely, given that the perpetrators enjoy certain qualities that presuppose integrity, as they are entrusted with public money.
