Résumé: ملخص المذكرة لأدلة الإثبات دور كبير وهام جدا في حل الخلافات المعروضة أمام القضاء، وهي السبيل لوحيد للأفراد من أجل إثبات حقهم والدفاع عنه، بالإضافة إلى كونها أداة أساسية يجب أن تكون في يد القاضي كي يستطيع الحكم بعدل وإنصاف كما أن أدلة الإثبات تختلف من دليل لأخر، وقد قمنا بتقسيمها من حيث القوة، إذ تعتبر قوة المحرر الكتابي و الإقرار واليمين الحاسمة مطلقة مقارنة بالقرائن و شهادة الشهود واليمين المتممة وكذا الخبرة والمعاينة، فقوتها محدودة. و بإعتبار أن القاضي هو الفاصل في النزاعات فسلطته في تقدير الأدلة تختلف من دليل إلى آخر. Note summary Evidence has a great and very important role in resolving disputes before the judiciary, and itis the onlyway for individuals to prove and defendtheir right, in addition itis an essential toolthat must be in the hands of the judgesothathecanrulefairly and equitably. The evidencediffersfrom one evidence to another, and we have dividedit in terms of strength, as the power of the written editor, the affirmation, and the decisiveoathisconsideredabsolutecompared to the evidence, witnesstestimony, and the complementaryoath, as well as experience and inspection, as itsstrengthislimited. Consideringthat the judgeis the arbiter of disputes, hisauthority in evaluatingevidencediffersfrom one evidence to another.
