Résumé: يتم إبرام عقد النقل الجوي للركاب وتنفيذه بين الناقل كمحترف والمسافر كمستهلك لخدمة النقل. إلا أن الطرف الأول يحتكر نشاط النقل، بينما لا يستطيع الطرف الثاني الاستغناء عن هذا النشاط، مما يجعل عقد النقل الجوي عقد التزام يفرض من خلاله الناقل شروطه التعاقدية على شكل عقود نموذجية والتي لا يمكن مناقشتها، ومن أجل استعادة التوازن التعاقدي المطلوب، فإن ذلك يتطلب توافر الحماية القانونية للمسافر بالإضافة إلى الحماية التعاقدية.
