عن دور سلطة ضبط السمعي البصري في تحقيق فعالية الضبط القطاعي

Résumé: بعد مرحلة الاحتكار والهيمنة الإدارية والسياسية التي فرضت على القطاع السمعي البصري لعقود زمنية كثيرة، جاء القانون الإعلام رقم 12-05، والقانون رقم 14-04 المنظم للنشاط السمعي البصري لطي هذه المرحلة ، وفتح مرحلة جديدة بإنشاء هيئة ضبط قطاعية هي سلطة ضبط السمعي البصري ، من أجل التوفيق بين حماية الحرية الإعلامية وتجسيد آليات الضبط الاقتصادي ومبادئه على المؤسسات السمعية البصرية العامة والخاصة. إلا أن رغبة السلطات العامة في إبقاء السيطرة على هذا القطاع الحساس، جعلت من سلطة الضبط السمعي البصري ،لا تؤدي دورها بالفعالية المنتظرة ،لكونها ضابط ثانوي فهي لا تتدخل في مجال الرقابة على المؤسسات إلا على سبيل الاستشارة لصالح الضابط الحقيق،إلا أنها هيئة قمع على تلك المؤسسات ،تجمع بين سلطة التحقيق وتوقيع العقوبات عليها ،في ظل مناخ ضعف التقيد فيه بضمانات المحاكمة العادلة. After the period of monopoly and administrative and political hegemony which imposed itself on the audiovisual sector for decades, the organic law n°12-05 of the media and the law n°14-04 regulating the audiovisual activity closed this phase and opened a new phase by establishing an independent sectoral regulatory body in order to reconcile the protection of media freedom and the embodiment of the mechanisms and principles of economic regulation on public and private audiovisual institutions. However, the desire of the public authorities to maintain control over this sensitive sector has meant that the audiovisual regulatory authority, does not exercise its role with efficiency, because it is a secondary officer, these institutions combine the power of investigation and sanction against them in an environment of weak respect for the guarantees of a fair trial.
