عن القوة الإلزامية لمصادر قانون التجارة الدولية

Résumé: الملخـــص: تخضع عقود التجارة الدولية لمبدأ قانون الإرادة، الذي يسمح لأطراف هذه العقود اختيار القانون الواجب التطبيق على عقودهم الدولية. ففي كثير من الأحيان قد يقع اختيار المتعاقدين على قواعد قانون التجارة الدولية، والذي من أهم خصائصه تعدد وتنوع مصادره بين وطنية، دولية واتفاقية. هذا التنوع ادى إلى اختلاف القوة الإلزامية لقواعده بحسب المصدر الذي تنتمي إليه، ما يجعل اختيار قواعد هذا القانون من قبل المتعاقدين لتنظيم العقد التجاري الدولي ليس بالأمر الهين ويحتاج إلى الكثير من الخبرة والمعرفة بهذه المصادر، فالمتعاقدون في هذه الحالة مجبرون على ضرورة حسن اختيار قواعد المصدر الأكثر تمتعا بالقوة الإلزامية الضرورية لإنشاء وتنفيذ عقد تجاري دولي يضمن حقوق أطرافه، خاصة في حالة نشوء اي نزاع بينهم. Abstract : International trade contracts are subjected to the principle of the law of will, which allows contractors to choose the law must applicable to their international contracts. Often, they may choose the rules of international trade law knowing that the most important characteristics of this law is the diversity of its sources between national, international and convention. This diversity led to a variation in the binding force to its rules according to the belonging source. This makes not easy the selection of the rules of this law by the contractors to regulate the international commercial contract and requires a lot of experience and knowledge of these sources. In this case, the contractors are obliged to well choose the source rules which have the necessary binding force for the establishment and the execution of an international commercial contract that guarantees the rights of itsor parties, especially in the emergence of any conflict in between them
