مبدأ التكامل في العقاب على الجرائم الدولية (جريمة العدوان أنموذجا)

Résumé: يقوم عمل المحكمة الجنائية الدولية على مبدأ التكامل الذي لا يسمح لها بالتحقيق في الجرائم الدولية المرتكبة والعقاب عليها إلا إذا ثبت عجز أو تواطئ أو صورية المحاكمة أمام القضاء الوطني، ولهذا المبدأ آثار متعددة ترتبط بخصوصيات جريمة العدوان باعتبارها أحد الجرائم الداخلة ضمن النطاق الموضوعي لعمل المحكمة. وتهدف هاته الدراسة لتسليط الضوء على مفهوم مبدأ التكامل وآثاره المفترضة على جريمة العدوان خصوصا وأنها الجريمة التي دخلت أخيرا حيز التنفيذ بعد توفر شروط العقاب عليها وانقضاء المهل القانونية بشأنها، من خلال اعتماد المنهجين الوصفي والتحليلي القانوني. The work of the International Criminal Court is based on the principle of complementarity, which does not allow it to investigate and punish international crimes committed, unless it is proven inability, complicity, or sham trial before the national judiciary. This study aims to shed light on the concept of the principle of complementarity and its supposed effects on the crime of aggression, especially since it is the crime that has finally entered into force after the provision of punishment conditions for it and the expiration of legal deadlines regarding it, by adopting the descriptive and analytical legal approaches.
