الأشتراط في عقد الزواج وضوابطه بين الفقه الأسلامي وقانون الأسرة الجزائري ( دراسة مقارنة)

Résumé: "لقد أثار موضوع الاشتراط في عقد الزواج جدلا كبيرا في أوساط المجتمعات الإسلامية، باعتبار الشروط الجعلية الناجمة عن اختيار الطرفين أمرا غير أصلي في عقد الزواج وقد سلمت الشريعة الإسلامية وقانون الأسرة الجزائري بمشروعية الاشتراط ولكن بقي الخلاف عند فقهاء الشريعة الإسلامية في الضوابط التي تحكمه بين مؤيد ومعارض، وكذلك فعل المشرع الجزائري حينما نص على عدم مخالفة الشروط لأحكام الأسرة. ويرى الفقه الإسلامي أن تكون الشروط متماشية ومقتضى عقد الزواج ، وإلا اعتبرت باطلة، بينما رتب لها قانون الأسرة الجزائري ثلاثة عقوبات : الفسخ أو التعويض أو الدفع بعدم التنفيذ. "The issue of setting conditions in the marriage contract has sparked great controversy among Islamic societies, considering that the statutory conditions resulting from the choice of the two parties are not part of the marriage contract.Islamic Sharia and Algerian family law have recognized the legitimacy of the conditions, but the controversy remained among the jurists of Islamic Sharia regarding the controls that govern it between supporters and opponents,as well as settingit a set of restrictions,the same was done by the Algerian legislator when he stipulated that the conditions should not violate the provisions of the family. Islamic jurisprudence considers that the conditionsshould be in line with the requirements of the marriage contract, otherwise it is considered invalid, while the Algerian Family Code arranged for it three penalties: annulment, compensation, or non-implementation
