هل للمركزية اعتبار لدى الشارع في الأحكام المالية؟

Résumé: يبحث هذا الموضوع أثر الأخذ بالتقنيات المالية المعاصرة وتقلص دور مركزية البنوك والمؤسسات على الفعل الاقتصادي، فإن ما يشهده العالم من ثورة في التقنية أنتجت تطبيقات ومنتجات جديدة كالبلوكشين والعملات المشفرة والعقود الذكية، أدت إلى تغير النظرة إلى التمويل عموما وإلى دور المؤسسات التقليدية من بنوك وبورصات وشركات وأنظمة قانونية وقضائية، وهو الأمر الذي يستدعي من الفقهاء والاقتصاديين البحث والاجتهاد، وقد بينت معنى اللامركزية ومخاطرها وإيجابياتها، ثم قمت بتأصيل مدى تدخل الدولة في الأحكام المالية وعلاقة ذلك بالاقتصاد اللامركزي، وخلصت إلى أنه يمكن للتقنيات المالية أن تكون دافعة لتطور جهات التمويل التقليدي من بنوك مركزية وبورصات . Abstract This topic examines the impact of the adoption of contemporary financial technologies and the reduced centralization role of banks and institutions on economic action. The revolution in technology the world is witnessing has produced new applications and products such as blockchain, cryptocurrencies and smart contracts, which have led to a change in the view of finance in general and the role of traditional institutions such as banks, stock exchanges and companies. And legal and judicial systems, which requires jurists and economists to research and diligence, and I clarified the meaning of decentralization, its risks and advantages, and then I established the extent of the state’s intervention in financial provisions and its relationship to the decentralized economy, and concluded that financial technologies can be a driver for the development of traditional financing bodies from banks Central and stock exchange
