حق المواطن في الوصول إلى المعلومات

Résumé: ملخص: إن الاطلاع على المعلومات التي تحتفظ بها المؤسسات العامة حق من حقوق المواطن، وذلك باعتباره صاحب الشأن في هذه المعلومات، وتهدف ممارسة هذا الحق إلى تعزيز الديمقراطية التشاركية، وضمان مساهمة الجميع في التنمية. ولقد قرر حق المواطن في الوصول للمعلومات في كافة المواثيق الدولية لحقوق الانسان، الأمر الذي دفع بالدول والمنظمات العالمية والإقليمية إلى الاعتراف بهذا الحق، وهو ما دفع بكل الدول المتحضرة إلى تبنيه، وتكريسه في دساتيرها وقوانينها الداخلية. ويستند هذا الحق إلى مبادئ عديدة أهمها مبدأ حدود الكشف الأقصى عن المعلومات، خاصة ما تعلق منها بحقوق الانسان، والبيئة، وغيرها، وكذا مبدأ التضييق من نطاق الاستثناءات التي ترد عليه، وحصرها على وجه الدقة وفق معايير محددة، استجابة لضرورة تستدعي ذلك، بهذا فقط تسود الثقة بين المؤسسات العامة والشعب. :Abstract Access to information held by public institutions is one of the rights of the citizen, as he is the stakeholder in this information, with the aim of strengthening participatory democracy and monitoring the extent of respect for human rights, as well as everyone’s contribution to development. This right has been recognized by all global and regional organizations, the most important of which is the United Nations and all human rights organizations, which prompted all civilized countries to clarify this right and enshrine it in their constitutions and internal laws. This right is based on many principles, perhaps the most important of which is the principle of the maximum disclosure of information, especially those related to human rights, the environment, and others. The limits of disclosure should not be narrowed in the context of an extreme necessity that calls for this to be precisely determined according to specific standards. Only this trust prevails between institutions The public and the people.
