الأوامر الاستعجالية الفاصلة في الموضوع طبقا لقانون الاجراءات المدنية و الادارية

Résumé: أسند قانون الإجراءات المدنية والإدارية لقاضي الاستعجال اختصاصا أصليا يمارسه وفق الضابطين الواردين في مادتيه 299 و303، وهما ضابط الاستعجال و عدم المساس بأصل الحق، واختصاصا استثنائيا لا يتقيد فيه بهما يمارسه في إطار مادته 300 للنظر في القضايا التي يسنده إياها المشرع بنصوص خاصة. تتمتع دعاوى الموضوع التي أسند المشرع لقاضي الاستعجال اختصاص نظرها بالمميزات الإجرائية للدعوى الاستعجالية، كقصر مواعيدها، القوة التنفيذية للأمر الصادر فيها وطرق الطعن المقررة ضده، وفي نفس الوقت بمميزات دعاوى الموضوع بتمتع الأمر الصادر فيها بحجية الحكم الفاصل في الموضوع التي يفتقر لها الأمر الاستعجالي العادي، و خضوعه للطعون القضائية المقررة ضده خروجا عن القواعد العامة التي تحكم الطعن في الأوامر الاستعجالية. : The code civil and administrative procedure assigns an original jurisdiction to the judge of expedited matters, exercised according to the two criteria mentioned in articles 299 and 303, which are emergency and non-prejudice to the origin, and an exceptional jurisdiction exercised independently of these two criteria within the framework of article 300 to examine cases assigned by the legislator by special provisions. Substantive lawsuits assigned by the legislator to the judge of expedited matters enjoy both procedural characteristics of the referee lawsuit in matter of short-term, executive force of the order and methods of remedy, and of substantive lawsuits in which the order enjoys the force of res judicata and judicial remedies in referee orders.
