واقع حماية حقوق الإنسان في النظام القانوني الجزائري

Résumé: إن تكريس الدول لحماية حقوق الإنسان ضمن قوانينها الداخلية هو خطوة أساسية في سبيل تجسيد تلك الحماية للأفراد على المستوى العملي، وهي التزام بتنفيذ المعاهدات الدولية لحقوق الإنسان، وهو ما عملت عليه الجزائر من خلال إدراج حماية هذه الحقوق في تشريعاتها مع إعمال الدستور لمبدأ سمو المعاهدات الدولية على القانون. وقد هدفنا من خلال دراستنا إلى الوقوف على التزام الجزائر عمليا بمعاهدات حقوق الإنسان من خلال تعزيز دور القضاء في حماية تلك الحقوق، مع الحرص في الوقت ذاته على الموازنة بينها وبين اعتبارات السيادة الوطنية، عن طريق تحرّي النصوص القانونية التي وافقت الدولة على تطبيقها كلّية والوقوف على النصوص التي فسرت جزءا منها، أوتحفظت عليها، أواستبعدتها تماما لتعارضها مع النظام العام الداخلي. Abstract: The consecration of states to the protection of human rights within their domestic laws is an essential step towards embodying that protection for individuals at the practical level, and it is a commitment to implement international human rights treaties. That is what Algeria has worked on by including the protection of these rights in its legislation with the constitution’s implementation of the principle of the supremacy of international treaties on the law. Algeria's and we need through our study to clarify human rights has been confirmed in practice by strengthening the role of the judiciary in protecting these rights, while ensuring at the same time a balance between them and considerations of national sovereignty, by examining the legal texts that the state agreed to fully implement and stating the texts that interpreted part of them, Or have reservations about it, or completely excluded it because it conflicts with the internal public order.
