النظام التأديبي للقضاة في التشريع الجزائري The Disciplinary System If Judges In The Algerian Legislation

Résumé: إستهدفت الورقة البحثية موضوع النظام التأديبي للقضاة في التشريع الجزائري، حيث أن القاضي وعند مزاولته لعمله الوظيفي فهو معرض لإرتكاب أخطاء منافية لواجباته الوظيفية الحساسة أو لجرائم القانون العام، وبالتالي فهو معرض للإحالة على التأديب. وبالنظر لخصوصية ومكانة القاضي فقد أفرد المشرع الجزائري نظام خاص لتأديب القضاة، يراعي من جهة إستقلاليته وحصانته، ومن جهة ثانية يكون رادعا له ولغيره من العودة الى إرتكابها The purpose of this research paper, is to examine the Disciplinary System of Judges in the Algerian Legislation. The judge, in practicing his/her career is liable to commit mistakes that violate his/her duties of common law offenses. And therefore, is subject to referral to discipline. In viewing the judges specificities and status, the Algerian Legislation set up a special system for their disciplining. Taking into account, on the one hand, the judge Independence and immunity. And on the other hand, to be a deterrent to him and the others to do not commit such mistakes again.
